These Terms of Service (“Terms”) govern your use of the client portals and booking services operated by Kosmic Edge LLC (“Kosmic Edge,” “we,” “us”), including the KE Marketing (Horizon) and James Wick Photography brands (collectively, the “Services”). By using the Services, you agree to these Terms.

Accounts

You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your account credentials. You must be at least 18 years old to use the Services.

Bookings, documents & payments

The Services let you request and manage bookings, receive and sign documents, and view and pay invoices. Booking requests are not confirmed until accepted. Payment terms for a given service are presented at the time of booking or invoicing. You agree to pay all amounts owed for services you book.

SMS text messaging program

By providing your mobile number and opting in, you consent to receive recurring transactional SMS text messages from Kosmic Edge LLC and its brands related to your account and bookings.

• Program description: booking confirmations, schedule changes, appointment reminders, payment reminders, and invoice notifications.
• Message frequency varies based on your account activity and bookings.
• Message and data rates may apply. Rates are charged by your mobile carrier and are your responsibility.
• Opt out: reply STOP to any message to unsubscribe. You will receive a confirmation and no further messages unless you opt in again.
• Help: reply HELP for assistance, or email [email protected].
• Consent to receive SMS is not a condition of purchase of any goods or services.
• Carriers are not liable for delayed or undelivered messages.

Acceptable use

You agree not to misuse the Services, interfere with their operation, attempt to access accounts or data that are not yours, or use the Services for any unlawful purpose.

Intellectual property

The Services and their content are owned by Kosmic Edge LLC and its licensors and are protected by applicable law. Photographs and deliverables are governed by the separate service agreement applicable to your booking.

Disclaimers & limitation of liability

The Services are provided “as is” without warranties of any kind. To the fullest extent permitted by law, Kosmic Edge LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the Services.

Changes to these Terms

We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms. Material changes will be reflected by updating the “Last updated” date above.
